Job Information | Head of Litigation Our law firm client, a growing corporate and commercial practice is seeking to appoint a Head of Litigation. Ideally you will be conversant in both civil and commercial matters and will relish the task of building a new litigation law practise situated in Sussex. This position is open to all talented litigators who are not only looking to make partner within 2/4 years but a law professional looking to design their own litigation practice. Current partners “Consultant deal to Partner agreement can be made”. We are seeking to find – Civil – Advice to claimants on the validity of claims, and defendants on whether to settle or fight a claim made against them. Drafting ‘Letters Before Action’ in high cost litigation matters and negotiated out of Court settlements. Issue Court proceedings on a process of alternative dispute resolution. Gather evidence and witness statements and attended trials, arbitrations and mediations with clients. Assist barristers in matrimonial and property disputes. Preparation of claim forms, of claim, statutory demands, bankruptcy petitions and applications for attachment of earnings orders, warrants of control, judgment in default, interim charging orders and final charging orders in relation to debt recovery actions against clients. Represent the firm at interim and final charging order hearings. Acting on behalf of claimants and defendants in property disputes, debt recovery. Produced Settlement Agreements in preparation for a mediation. Drafting ‘Letters Before Action’, Part 36 Offers. Claim Forms and Witness Statements. Case preparation for civil injunction breeches. Location and liaison of experts then drafting joint instructions, complete petitions and relevant applications in contested divorce proceedings, deal with matrimonial asset disputes. Commercial – Advising clients against former legal advisors. Assist Claimants in group litigation involving fraudulent property transactions. Preparation of and service of freezing injunction proceedings. Draft costs budgets, directions and dealt with case management conferences. Implemented a new e-Disclosure platform to assist with disclosure and effective document management. Assist Claimants in claims relating to four separate disputes arising out of a dissolved partnership. Examine relevant partnership contracts, advise on the terms. Group litigation for fraudulent property transactions. Serve judicial documents out of the jurisdiction and advised on the EU Service Regulation requirements. Personal injury claim for alleged food poisoning. Claims against independent financial advisor for negligent foreign property investment advice. Complaints to the Financial Service Ombudsmen. Loan agreement arrears. Property – Representing clients in general property litigation matters from both a Landlord and Tenant aspect in both Residential and Commercial properties. Managing and dealing with the litigation matters for both commercial and residential units. Undertaking possession claims for both residential and commercial premises in respect of rent. Arrears, breaches of lease and disrepair. Obtaining injunctions for of breaches of leases for both residential and commercial premises, Dealing with all enfranchisement and lease extension claims and advising the company thereon and dealing with any claims that arise thereon Representing company general property litigation matters from mainly a Landlord aspect Acting for company in the drafting of Section 25 and 25 Notices together with advising either parties as to their rights under the Landlord and Tenant Act 1954 Acting for company in both contentious and non-contentious Lease Renewal proceedings under the Landlord and Tenant Act 1954 Acting for company on all other Commercial Litigation matters.
