Summary of Role:
The Head of Property supervises other property staff as well as undertaking fee earning work. This will include the conveyance of freehold or leasehold, residential, commercial and agricultural property or land as well as creating easements and wayleave agreements.
Reports to
Managing Partner.
Responsibilities:
• To actively contribute to the running of the firm and to its long term strategy, to create and be responsible for departmental plans and strategies.
• Coach, appriase, train and develop any staff reporting using the firm’s system and contribute to appraisals by or of, others.
• Supervise staff and their work and ensure that they meet their targets and those targets have associated activities and behaviours. Ensure proper control of work in progress for all staff reporting such as;
key dates, risk management, billing and cash collection, time write off etc.
• To organise and lead office and departmental meetings, leading by example with contributions made at and subsequent to such events, following up on decisions and actions.
• To be part of the management team of the firm.
• Perform fee earning work accurately, reliably and in accordance with the firm’s quality and risk management and other work procedures.
• Assist in the develop and support marketing initiatives for the office.
• Maintain familiarity with the key roles within the firm and the firm’s policies and procedures and actively work with staff to ensure compliance.
• To identify and manage property risks for the firm.
• To act on behalf of a financial lender when required and balance the interests of the lender with those of the client.
• To manage the Conveyancing process and flow of work using the case management system paying due attention to key dates and actions.
• To interact with others involved in the Conveyancing process such as the Cashier; if the Conveyance is part of another process such as probate, the instructing Solicitor; the ‘other side’ of the transaction;
any land or estate agent.
• To manage the financial side of any property transaction, this will include:
o taking money on account;
o ensuring that funds are sufficient and available at exchange of contracts and completion;
o accounting to a funds provider or their agent at the end of the conveyance;
o producing a completion statement which will identify all key parts of the financial transaction;
o accounting and paying to HMRC for any tax payable in a timely manner;
o accounting and paying to the client the balance of any monies.
o ensuring that all financial parts of the transaction accord with SRA accounts rules.
• To ensure good title is provided before exchange of contracts; carrying out such searches as required.
· To ensure that all property transactions by staff are registered with the Land Registry and that all paperwork is completed correctly and in a timely manner.
Skills and Knowledge required:
· Supervision and Development and Training of property staff.
· Ability to source work and has a track record of new business development (this does not mean converting clients or dealing with existing ones).
· Knowledge and understanding of all parts of the Conveyancing process this includes:
o Requirements by Mortgage/Financial lenders;
o Requirements by HMRC;
o Requirements by HM Land Registry;
o SRA & Law society rules and regulations;
o Requirements by Local Authorities.
o Requirements of the firm
· Good Financial comprehension and arithmetic;
· Good interpersonal and client skills.
o Up to date legal knowledge of the work area and completed CPD points, excellent understanding and comprehension of property law including:
o Freehold property;
o Leasehold property;
o Agricultural property;
o Commercial;
o Residential.
· Qualification as a Solicitor, Legal Executive or Licensed Conveyancer with a minimum of 5 years’ experience of property work
o Understanding of Lexcel requirements and working accordingly.
o Understanding financial aspects of matters and the organisation with particular emphasis on cash-flow.
o Use and maintain IT skills appropriate to modern legal practice, such as using the case management system; e-mails with or without attachments; conducting research on internet and legal precedent systems and
ensure electronic filing of all data.
o Clear disciplinary record in previous employment or a non-substantial disciplinary record for the last 10 years.
o To be a member of appropriate professional bodies.
