Junior Manager Designate
Our client a medium sized law firm that has been established for over one hundred and fifty years has a very busy private client practice. Due to the increase in population and recent new client intake coupled with the succession plans of the managing partner, we have been retained in search to find a new senior private clients lawyer.
This position could suit a young dynamic lawyer or legal executive that is looking to make a strategic career move into a junior management role. We are currently looking for a fee earner that has the following legal technical private client work skills and knowledge that has been clearly listed below.
Expect to be tested on your private client working knowledge which could include a pen to paper examination process. We are looking to place with our law firm client a competent lawyer who can show thorough expertise in private client work including leadership credentials.
If you have property conveyancing work experience even better, but this is not a pre-requisite or deal-breaker. Most of the heavy trusts work is conducted by an external consultant, if you have trusts work and set-up experience our client will have a very keen interest in you.
- Interviewing clients and advising on probate matters;
- Administration of estates including preparation of IHT400, IHT205 and oaths, IHT calculations affidavits, deeds of variation, deeds of appointment valuing shares, making claims for relief on loss on sale of shares and land, estate accounts;
- Income tax returns;
- Some administration of trusts and trust accounts;
- Lasting powers of attorney:
- Registration of enduring powers of attorney;
- Special needs trusts;
- Contested hearings;
- Preparation of enduring power of attorney, registration of enduring of attorney and receivership accounts;
- Preparing and submitting forms FR1, AP1, TR1, AS1 and RX3;
- Management, administration and distribution of estates;
- Probate and letters of administration for large and small estates including all aspects from initial interview with client;
- Preparation and drafting of all required special requirement documentation;
- Valuation of assets;
- Possible member of ACTTAPS;
- Possible memeber of Society of Trust and Estate Practitioners and the Law Society Probate Section;
- Preparation of Inheritance tax forms; obtaining the grant and dealing with the closure and the final tax issues;
- Distribution accounts;
- Wills including will trusts and estate planning relating to inheritance tax or care home fees;
- Preparation and drafting of wills and complex matters to do with wills;
- Inheritance tax planning drafting;
- Inheritance tax planning accounting and mitigation;
- Deeds of variation;
- Declarations of trust;
- Lifetime and post death tax planning;
- Creation and administration of trusts;
- Registering enduring powers of attorney;
- Drafting and enduring powers of attorney;
- Court of Protection receivership matters;
- Complex Court of protection work, administration and application;
- Preparation of HMRC inheritance tax accounts IHT200 and IHT205;
- Applying for grants of probate and letters of administration including drafting relevant and appropriate oaths and affidavits;
- Correspondence, preparation of estate accounts, file costing and drafting bills;
- Lasting powers of attorney;
- Registering EPAs and LPAs, preparing IHT205 and IHT400 forms;
- Drafting oaths for probate/administration;
- More complex matters of elderly client law;
- Lasting powers and all applications for Deputyship;
- Preparing and administering powers of attorney;
- Making receivership applications to the court of protection and representing clients at inquests;
- Power of attorney including advice to clients and assessment of mental capacity;
- Preservation of elderly clients assets;
- Long term care issues and funding ;
- Long term care issues using securitization and funding techniques;
- Out of office visits to clients homes, hospitals and care homes,
- Trust work and all administration and accounting;
- Obtaining grants of probate/letters of administration;
- Calculating and paying inheritance tax;
- Drafting deeds of variation and deeds of appointment (often in cases of nil rate band discretionary trusts);
- Liaising with the relevant financial institutions to obtain the required administration information;
- Administering estates, preparing estate accounts, drafting R27 and R185 forms;
- Discretionary trusts;
- Trust deeds administration;
Conveyancing Knowledge
- Knowledge of leasehold and freehold domestic/commercial conveyancing;
- HNI conveyancing
- Sale of probate properties;
- Transfers of equity and equity releases;
- Commercial business Issues;
- Taking instructions from clients;
- Sending terms of engagement and estimates of fees and disbursements;
- Obtaining or checking land registry documents or title deeds (if the land is unregistered);
- Drafting or checking sales contracts and agreeing terms with the lawyer acting for the other party to the transaction;
- Collating and sending or checking supporting documents;
- Exchanging contracts and completing the transaction;
- Dealing with all financial aspects of a transaction;
- If the property is leasehold, obtaining the landlord’s agreement to the sale or the change of mortgage and dealing with apportionments of rent and service charges;
- Specific tasks for sales transactions include preparing the seller’s property information form; repayment of charges and paying the estate agent’s fee;
- Carrying out and checking pre-contract searches by checking whether the property is affected by local authority proposals, leases, easements or covenants, mortgages, land tax, susceptibility to flooding or subsidence, or liability for unsound building structures and repairs;
- Receiving and checking mortgage instructions from lenders and undertaking specific tasks required;
- Preparing transfer and mortgage deeds;
- Receiving mortgage funds;
- Paying stamp duty and land tax and dealing with the registration of client and lender with the land registry.
